Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your use of Petal, a plant identification application ("Service") operated by Barael LLC, a California limited liability company ("Barael LLC," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Petal allows users to photograph plants and flowers to receive identification information including common names, scientific names, growing conditions, and historical context. Identification results are generated by AI and are provided for informational and educational purposes only. We make no representations as to their accuracy, completeness, or fitness for any particular purpose, including horticultural, medical, or safety decisions.
3. Eligibility
You must be at least 13 years of age to use the Service. By using Petal, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. User Accounts
You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at hello@eddievaldez.ai.
5. User Content
By uploading images or other content to the Service ("User Content"), you grant Barael LLC a non-exclusive, worldwide, royalty-free license to store, process, and display that content solely to provide the Service. You retain ownership of your User Content. You represent that you have the rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.
6. Prohibited Conduct
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse engineer, decompile, or disassemble the Service; (c) use automated means to access the Service without our express written permission; (d) upload content that is harmful, obscene, defamatory, or infringes any third-party rights; or (e) interfere with or disrupt the integrity or performance of the Service.
7. Intellectual Property
The Service, including all software, design, text, graphics, and other content (excluding User Content), is owned by Barael LLC and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license to use it as set forth herein.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BARAEL LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BARAEL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF $50 USD OR THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM.
10. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, with or without notice. Upon termination, your right to use the Service ceases immediately.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the effective date above. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
